Acceptance of Terms

By accessing and using the services of The 1645 Group you agree to comply with these Terms and Conditions (T&Cs). If you do not agree with any part of these T&Cs, you must not use our services.

 

Description of Services

The 1645 Group provides both live and remote, via an app, health and wellbeing services, including but not limited to physical coaching, yoga, sports massage, meditation, fitness training, live group classes and health and wellbeing coaching.

 

Modifications to Service and Prices

Prices for our services are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

 

Health Disclaimer

You acknowledge that you have consulted with a healthcare professional before beginning any new health and fitness programme. The 1645 Group is not a medical organisation, and our staff cannot give you medical advice or diagnosis.

 

Registration, Booking and Accounts

To access some services, you may be asked to provide certain registration details or other information via a third-party app. It is a condition of your use of the services that all the information you provide is correct, current, and complete. Classes and coaching sessions should be booked via our website.  All services are subject to availability and confirmation.

 

Payment Terms

For services requiring payment, we accept payment through various methods. Services are billed in advance on a monthly or session basis, as agreed upon in our online booking process. Please note that the booking process is subject to availability and confirmation. Payment for our services is due at the time of booking. We accept payment through our website using a secure payment gateway.

Fees for in-person training delivered in Harrow on the Hill include hire of the facilities, your coach, and programming your coach will do before each session.

 

Cancellation Policy

If you need to cancel or reschedule a service appointment, you must do so with a minimum notice of 48 hours for 1:1 coaching and 24 hours for classes, failing which, you may be charged the full cost of the session. Refunds are not available for services unless cancellation is made within 48 hours for 1:1 coaching or 24 hours for classes.  In the event that due to unforeseen circumstances a class or coaching session is cancelled by The 1645 Group a full refund will be issued. 

 

User Conduct

Users of services offered by The 1645 Group are expected to always behave in a respectful and law-abiding manner when using our services and interacting with our coaches and other clients. Users are expected to behave in a respectful manner when accessing our services in locations in Harrow on the Hill.

 

Intellectual Property Rights

The content of our website and other third-party apps, including text, graphics, images, and the trademarks, service marks, and logos contained therein, are owned by or licensed to The 1645 Group.

 

Confidentiality

Client confidentiality is paramount. We are committed to keeping all conversations and records private and will not disclose client information without consent, except as required by law.

 

Limitation of Liability

The 1645 Group will not be liable for any incidental, special, consequential, or indirect damages arising out of or related to the use or inability to use our services. The 1645 Group and its coaches are not liable for any injuries or damages that may occur during or because of our services. By booking these services, you agree to release us from any liability.

 

Governing Law

These T&Cs are governed by and construed in accordance with the laws of England.

 

Changes to Terms

We reserve the right, at our sole discretion, to change or replace these T&Cs at any time.

  • Personal Identification Information: Such as name, email address, telephone number, physical address, and payment details.
  • Health Information: Health and medical information that you voluntarily provide for customised service provision.
  • Notes for your Personalised Programme – your coach might develop session notes after a session to ensure consistency and the ongoing development of your programme. This information is available for you to request at any time. 
  • Technical and Usage Data via our website/app: This includes your IP address, browser type, visit durations, page views, navigation paths, and service usage patterns.

 

Lawful Basis for Processing

We process your personal data under the following lawful bases:

  • We may process your data if you have given us explicit consent to use your personal data for a specific purpose.
  • Processing is necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract.
